Intellectual property

All content on the orkelia.com website (texts, images, logos, code) is the exclusive property of Orkelia and is protected by French and international laws relating to intellectual property. Any reproduction, representation or distribution, in whole or in part, is prohibited without prior written authorization.

2. Terms and Conditions of Sale

2.1 Purpose

These terms and conditions of sale govern the sale of Orkelia services (operational AI platform for clinics) between Orkelia and any healthcare professional or clinic manager (the "Client").

2.2 Services offered

2.3 Order and payment

The subscription is made online via the orkelia.com website. Payment is processed securely by Stripe. The subscription is automatically renewed each month on the anniversary date of the subscription.

2.4 Right of withdrawal

In accordance with article L.221-18 of the French Consumer Code, the Client has a period of 14 days from the subscription to exercise their right of withdrawal, without having to justify reasons or pay penalties.

To exercise this right, the Client must notify their decision by email to contact@orkelia.com.

2.5 Termination

The Client may cancel their subscription at any time from their client area (Dashboard → Profile & Subscription → Cancel subscription) or by email. Termination takes effect at the end of the current subscription period. No refund will be made for the period already paid.

2.6 Orkelia's obligations

• Provide the services described in the subscribed offer
• Ensure the availability of the platform (target of 99.5% monthly uptime)
• Protect the Client's data in accordance with the GDPR
• Go-live guarantee: if the priority workflow is not operational within the announced timeframe, Orkelia extends the support at no additional cost

2.7 Client's obligations

• Provide accurate information at the time of subscription
• Use the services in compliance with applicable laws
• Not use the AI agents to provide medical advice
• Maintain the confidentiality of their login credentials

2.8 Limitation of liability

Orkelia is an operational assistance solution. The AI agents do not replace medical staff and do not provide any medical advice. Orkelia cannot be held liable for decisions made on the basis of the AI agents' responses.

Orkelia's liability is limited to the amount of the sums paid by the Client over the 12 months preceding the triggering event.

2.9 Applicable law

These terms and conditions of sale are subject to French law. Any dispute relating to their interpretation or performance falls under the exclusive jurisdiction of the French courts.

3. Privacy Policy

3.1 Data controller

3.2 Data collected

• Identification data: last name, first name, professional email, phone
• Clinic data: name, specialty, address
• Billing data: processed directly by Stripe (not stored by Orkelia)
• Usage data: conversations between the AI agents and the clinic's patients
• Technical data: IP address, browser type, access logs

3.3 Purposes of processing

• Provision and improvement of Orkelia services
• Management of client accounts and billing
• Technical support and communication
• Compliance with legal obligations

3.4 Legal basis

Processing is based on the performance of the contract (terms and conditions of sale) and compliance with legal obligations.

3.5 Retention period

• Account data: duration of the subscription + 3 years
• Billing data: 10 years (accounting obligation)
• AI agent conversations: 12 rolling months
• Technical logs: 6 months

3.6 Data recipients

The data is processed by the following sub-processors:

• Supabase (database) — European Union
• Vercel (hosting) — United States, governed by the standard contractual clauses
• Anthropic (AI) — United States, governed by the standard contractual clauses
• Stripe (payment) — United States, PCI-DSS certified
• Resend (emails) — United States

3.7 Rights of individuals

In accordance with the GDPR, you have the following rights:

• Right of access to your data
• Right of rectification
• Right to erasure ("right to be forgotten")
• Right to portability
• Right to object
• Right to restriction of processing

3.8 Security

Orkelia implements the following technical and organizational measures:

• Encryption of data in transit (HTTPS/TLS)
• Encryption of data at rest (Supabase)
• Data isolation by clinic (Row Level Security)
• Restricted access to production data
• API keys stored server-side only

4. Cookies

Orkelia uses only the cookies strictly necessary for the operation of the service:

• Session cookie (Supabase) — maintains the user's connection. Duration: session + 7 days. Cannot be disabled.

No advertising or third-party tracking cookies are used. No data is sold to third parties.
